Dear Dato' Lee,

Further to our update to you on 8 May 2008, we are pleased to report that there has been an enthusiastic response from purchasers who have come forward to settle their final payments, as early as last Friday.  We are encouraged by the response shown and we hope that purchasers would finally be able to enjoy the use of their properties.  

I would like to take this opportunity however, to apologise to purchasers whom may have experienced some inconvenience in the midst of all this excitement of collecting their keys.  Inevitably, we ourselves were overwhelmed in dealing with the initial response from purchasers.

We have however, taken suggestions from well-meaning purchasers as well as Pritpal, in his capacity of the Chairman of the RA Buyers' Committee in collecting payments and handing over keys.  We have, with effect from last Monday and up to 24 May 2008, stationed our officers at the management office, located at the 6th floor of Rhythm Avenue, to collect payments.

To further assist purchasers, our officers would be available at the management office for the next 2 Saturdays, to receive payments as follows.  The payment and collection of keys schedule at the management office is as follows:

Monday to Friday:        9.30 am - 4.30pm
Saturdays                9.30 am - 4.30pm (on 17 & 24 May only)

Please note that the final date for payment of all dues is on 24 May 2008.  

The management office will be open on subsequent Saturdays, from 9.30 am - 12 noon, solely for the purposes of collecting keys only.  

Please note that keys could only be given to purchasers upon clearance of all payments.  For purchasers who have taken bank loans, we urge purchasers to follow up with their respective financiers to ensure the timely release of their loans.  Purchasers intending to make payments are encouraged to make payments by bankers draft/ cashiers' order for immediate recognition of payment.

To answer some of the commonly asked questions asked by purchasers, we attach herewith a FAQ summary, to assist purchasers in addressing some of their queries

Where do I make payment?
 Payments are accepted at the management office located at 6th Floor of
Rhythm Avenue from 12 May to 24 May 2008. The collection hours are as
follows:
Mondays to Fridays: 9.30 am – 4.30 am

Where do I collect the keys?
 Keys can be collected from the management office, upon full settlement of
all outstanding dues.

What happens when I collect my keys?
 The staff at the management office, would accompany you to your unit and
conduct a joint inspection of your unit. Upon acknowledging receipt of your
property and the contents therein, you will be given custody of your keys.
The staff at the management office would explain the procedures to
purchasers in further detail upon collecting the keys.

Can I make payment by cheque?
 Purchasers are encouraged to make payment by bank draft or cashier’s
order, for immediate recognition of payment and delivery of keys. Payments
by cheques are accepted but would only be recognized for value upon
receiving confirmation from the bank of its clearance. Delivery of keys,
would therefore be subject to confirmation of clearance of cheques.

Can I authorize a family member/ friend to collect keys on
my behalf?
 Yes, you may. Kindly complete the “AL Form” which was enclosed with you
final billing and ask your authorized representative to bring this form along
when making payment. The AL Form must be signed by the purchaser, or
where there are more than one purchaser, by all purchasers.

Can the miscellaneous charges be waived/ reduced
 The miscellaneous charges are either a reimbursement of actual amounts
paid by us in respect of fire insurance premium, quit rent and assessment.
These cannot be reduced nor waived.
The service and maintenance charge is calculated at 20 sen per square foot
for the serviced apartment and RM1.20 per square foot in respect of the
retail units. The service and maintenance charges are calculated based on
an estimated budget to maintain and upkeep the property.
These are service and maintenance charges towards the proper
maintenance and upkeep of the property. These include security, electricity
and lighting of common areas, landscaping, swimming pool, maintenance of
lifts and other amenities, salaries and wages for maintenance staff, etc.
The service and maintenance charge includes a provision for the sinking
fund.
The monies collected in respect of service and maintenance charges will be
deposited into a building maintenance fund and surrendered to the Joint
Management Body (“JMB”) when it is formed in accordance to the Buildings
and Common Property Act (Maintenance and Management) 2007.
The JMB, comprising mainly of purchasers, may then decide if the rate for
service and maintenance charge is sufficient or insufficient to meet the
upkeep and maintenance cost of the property.

Understanding the miscellaneous charges
Insurance premium
 This is the apportionment of the actual insurance premium incurred for the
fire insurance policy taken by the developer in respect of the whole project.
The fire insurance premium is apportioned to all units are stipulated in
Clause 16* of the SPA.
If purchasers are end-financed, purchasers may inform their end-financiers
to discontinue their fire insurance policy taken on your behalf. We would
arrange to send copies of the Master Fire Policy taken on the project, to
your respective end-financiers.

Quit rent
 This is the apportionment of the actual quit rent paid on the project land and
apportioned to all units in accordance to Clause 17* of the SPA.
The quit rent has been partially waived by the Selangor State Government,
as a gesture of understanding and support towards the rehabilitation of
Rhythm Avenue.

Assessment
 This is the apportionment of the actual assessment paid on the property
land and apportioned to all units in accordance to Clause 17* of the SPA.
The assessment has been partially waived by the MPSJ, as a gesture of
understanding and support towards the rehabilitation of Rhythm Avenue.

Service and maintenance charges
 The initial collection of advance service and maintenance charges for 6
months in provided for in Clause 15 of the Deed of Mutual Covenants and is
intended to defray the initial costs of acquiring and setting up the necessary
infrastructure for the maintenance and upkeep of the property.

Deposits – Water and Service and maintenance
 These are refundable deposits in the purchasers’ name towards the
provision of water supply and towards their service and maintenance
accounts. These deposits are provided for in Clause 18* of the SPA and
Article 4.6* of the Deed of Mutual Covenants.

It is advisable to call your bank personally to expedite the 5% payment from your bank. This will speed up the payment process. PWC correspond with my banker CIMB in their old office in Kajang location. Kajang is their disbursement department. CIMB has been relocated to their Head Quarter in PJ parallel to Federal Highway. I found out this when I called up my lending branch.

Call up their HelpDesk number , fax all the necessary documents to them and they are more than willing to assist in the disbursement. My 5 % disbursement has been released after 3 working days.

If you have not do that, please spend , say 10 minutes to call your bank during office hour.

Just got my key two days ago.

Tested most of the facilities as follows:-

1. gym equipment - most of them in working condition
except one of the treadmill ( fused burnt)
2. the sauna ( men's toilet) is working fine.
3. lady's sauna not working, maybe main switch not on.
4. the lighting in men's locker room needs repair.
5. the surrounding plants and grass really need trimming.

Please make use of the facilities once your keys have been delivered to you.

When the time is right, i.e. when my unit is fully furnished,
you will not be left out in our invitation list.

When I collected my key, The car park is still not ready.
I was also told that each unit will be charged an additinal RM 50 monthly for the car park starting June. Maybe also with six month deposit and six month advancved payment.
We feel that the management had been unfair and took advantage the purchasers.

I have to agree with Mr Chong WH (who posted his comments on the 28th May 2008) that it is indeed inconsiderate for the Management to impose monthly car park rental fees on the Purchasers.

The Purchasers have waited for 10 long gruesome years for the project to be revived. Pardon me for using such harsh words but I guess the Purchasers will understand what I meant by 'gruesome'.

During these 10 years of waiting period, the Purchasers painstakingly continued to pay the financial interests to the banks. These interests, if added up, can range from RM50k to 100k! Just imagine how much interest we can earn if we chose to invest this money somewhere else, like fixed deposits or trust funds!

Although we thank God that the project has finally been completed and the keys are being handed over to the respective Purchasers, I sincerely hope that the Management can do one more good deed of waiving the car park rental fees.
