Feel cheated. When I bought an apartment in Newgate Avenue a few years ago, I was promised by the Developer that I would be given a free carpark lot. Recently, I have been informed that I need to rent or buy one from the new developer. The agreement did mention provision for car park lot but the word free not indicated. What's the best way to deal with such a situation?

since there is no new s & p. one should follow the old s & p, right ? or as suggested by feelgoodlast, wait and see or have a dialogue with the new developer before start of $$$ payment.
Car-park issue might not be the only one and other facilities such as the gym, suana, and others original facilities in the S & P contract are posibly affected. The gym to be privatised or 'piratised' ie, to contract to Fitness first and the public then and acess our facilities.
The committe has worked hard to revive the project. Kindly refrain from any action that might slowdown or stop this project.
Newgate buyers are lucky as they did not need to top up unlike rhythm.

The 'hiden top-ups' shall slowly reveal themselves liked car-parks and privatising gyms and more to be felt. We need to fall back to original S & P as accepted and novated to this New Developer as a basis to provided for. We have concede lost already and any more shall be contractual.

better wait for any outcome or development from the committee before anyone take any action. that would be a better choice than act first and latter found out that is not the case. any one have any idea when the first $$$ payment going to be ?

I do agree with Pritpal, micro & Eddie to complete the project first. The committee has indeed worked very hard to get it off the grounds. If one feels that it is unfair on the S & P, then please tell me that it was unfair that we had to bear our financial losses for the last few years since it stopped work. Bearing huge interest payments and paying for something that is still up in the air, I am very disappointed at some of the other buyers who are instigating all these without giving a chance to the majority of us who want the project up first.As for the car park issue, well, please wait and see how the new developer will entertain it when the project has gained some financial standing. To have them in is already a blessing. I hope that for those instigators, please think first before jeopardising it again.As for the facilities, is it that important that is to be discussed now? Once an Management Corporation has been set up, then your good contributions to the management of the condo will be valid and very useful then.

All are only anticipation and we have to prepair and expect the not-so-present issue so that one should not be that disappointed when the vacant possesion is given and the dust will stir up and settle bit by bit when the management start. We are all the grateful for all the efforts by the committee that has help to push forward and revive this project. This chapter on revival of this project has more or less done and the contractual obligation now lies with the new developer. We are comtemplating the next chapter.
Anticipation, true. However, we have fought the last 4 years with great anticipation. Our patience have been tested. God Willing, we will all sail through this chapter to the next chapter smoothly and with bright lights at the end of the tunnel.
Hopefully, it will be 18 months to go. It is fantastic that the developer has placed a webcam so that I can keep track eventhough I am out of the state/country!

So far I am happy with the progress of the development of the abandoned Project NG21. I would like purchasers of NG21 to comment on the sale of carpark lots. Were they aware of the need to purchase or rent carpark lots when they signed their sale and purchase agreements? I was told that a carpark lot will be given to each unit. If purchasers need to buy or rent, then some sort of conditions would be stipulated in the agreement. I need the views of purchasers so that we can come to some sort of a compromise. Also, I understand one purchaser has commented on the high price of carpark lot and security access.
Your views would be greatly appreciated.
Allocation provided under developer's terms and cond. Legally we are a lame-duck & we only to concede lost and left with no alternative.

This zest on the revival looked good and progressing well till end 2006 and 2007 till now slow to a stand-still and practically stalled, it look the $ not flowing in well. Can we confidently look to the completion comes Aug,08

It is very commendable of you to provide another avenue for the Newgate 21 buyers to share a common protal by introducing a new title "Newgate 21 Status" and for this I express my utmost gratitude. The current issue which was highlighted by Abby is indeed disturbing. I personally have called Yoga of PWC recently to ask on the matter and he mentioned that there was some issues between Pinggiran Setia and the subcontractors. Alas! the same issue again - non-payment by Pinggiran Setia to the subcontractors. Isn't this the same issue Solar Glow (previous developer) had? Is this a case of "pisang berbuah dua kali?". Haven't we learn any lessons from the past? How on earth did PWC identify Pinggiran Setia to be the developer then? I was made to understand that PWC's role is to manage the funds for this project. What happened to these funds? I would like to hear from PWC. I am not asking Dato' to do anything I understand that it is no more under your jurisdiction. We buyers are just leveraging on this portal. Maybe Pritpal and the committee could do their own investigations and report to the buyers what's happened. We'd rather hear from credible sources than making unfounded speculations. This is the least we deserve. On the speculation that work stopped due to orders from Ministry of Environment I certainly doubt this is true if any of the news reports on non-actions by the Ministry on much more serious environmental crimes are to go by. This is a simple case of dispute between Pinggiran Setia and the subcontractors which had victimised the buyers. We appreciate any party who can enlighten us further.

On March 31, 2007 I paid 15% progress payment (2e) to RHB Monitoring Account. Looks like I have made my financial loss bigger as the project is stalled again. I called PWH and was told that they had surendered all responsibilities to the new developer. I want to know if I can recover back my money for the last payment if things do not work out with them.

It's sad to hear your predicament. Hope the new contractors will be appointed soon. Mr Pritpal, any good news for us? I too am dissapointed with PWH. Looks like they're into this for the money. Now that they've got their loot, it's bye bye and "we do not know anymore". What a scam! Shame on you PWH!! You are just another vulture, just like the rest of them!
Since this is a grey area in the S & P, we shall wait until the completion of the project, then seek legal recource from the consumer's court or by then
if we are recognised by the housing tribunal, we should try till we are satisfied and concede to whatever. This is the economica means to protest.
