i need your guidance and advise in this issue, whoever has encountered this problem or anyone who could advise me what to do next...thanks.
i have bought an apartment in Subang Perdana Goodyear court 3, 3 years ago.
me and my sister moved in in February 2004, 2 weeks later, we noticed that the common bathroom wall was wet, and few days later, in the afternoon while my upstairs neighbour was showering, the water just started 'pouring' into my common bathroom.
i called up the previous owner, only then, 'the kind old uncle' who sold the unit to me mentioned that they had the same problem, and the upstairs owner has got someone to 'patched' it up, then they have painted the common bathroom and relocated wire in the bathroom. (that's why it seems so clean and nice when we went to view the unit :( ...)
From the maintenance office,i found out there was no water proofing treatment done to all the bathrooms in all Subang Perdana Goodyear Courts. According to them, water proofing treatment was not required by the government or the MINISTRY OF HOUSING & LOCAL GOVERNMENT when the apartment was being built.
The management office reply was: nothing to do with them.
the owner upstairs refused to spend money to fix it. according to her it has nothing to do with her, it is my problem. the previous onwer has recommended some maintenance guys from the management to do the water proofing at a special rate "paid directly" to the management office manager, and he took care of the bill because he has some 'special' arangement with them.
they done the water proofing and no water sipped through for the past 2 years....until 3 months ago....
we noticed the ceiling of the common bathroom has brown colour water marks, and wet. soon enough we noticed the wall has traces of brown colour water flowing down...
i called up a contractor to check, he told me that the water proofing upstairs was not done properly, and now the top of the 'tangki' is flooded with water, one side of the wall is all wet, and the worst thing is the wood that is support the 'tangki' is rotten...
i called the upstairs owner (she rented out the unit to some foreign workers) but she has changed phone number. i called up the management office to try to get her latest contact they told me they can not release, but they will help me to contact the owner.....all these happened 2 months ago... only thing i was told was to wait for the owner to contact me.
the owner never called me back.
last week we noticed that the ceiling is slanting towards one side, the water marks and traces of water getting worst, i called up the management to tell how serious is the damage and it may cause somebody injured, then only they gave me the upstairs unit's owner phone number.
she didn't pick the calls, and i sms her telling her who i am and hope that she would call me back. she didn't. i decided to sms her about the situation, and she finally, replied by sms saying that she will drop by to take a look on sunday (12th August).
we showed her the damage in our common bathroom, we told her our contractor told us the damage was done due to the water proofing in her unit was not done properly, and suggested that it is better to get a certified contractor to look at it. And you know what? she said this very common problem, she told us to to wipe the water dry and saying that she is doing us a fovour dropping by to see what's going on, and actually it has nothing to do with her, its our bathroom ceiling affected, not hers.
my questions:
1) what can i do next?
2) which government department shall i refer to? or is there any organisations would assist in this matter?
3) what do i do if i want to get the upstairs bathroom fixed but they refuse to corporate to let us repair?
4) What kind of legal rights do i have in this matter?
5) shall i engage a lawyer? what's the procedure? and how much would it cost me?
6) what is the management office role in this matter?

Very sorry to hear about your predicament but then I don't know how to advise you. I never really liked the idea of management companies running our apartment, after all they only sweep the floor, which you and me can do, ohh yess they paint the building FROM OUR MONEY....I had problems fixing the toilets too but the problem is not as big as yours.
Why don't you meet Dato Lee and ask his advice, maybe he has the power to discuss with S.P GY. Court Management to ask the upstairs neighbour to look into this matter collectively.
We study Moral and those days tatarakyat....but are we civic minded?...where is our ''Sifat Perihatin'' but in England they don't study all those S*** above, but have some common sense.
Commom sense is needed for both your neighbour and those in the Management Companies....I have lost the battle, good luck to you.
